Rule 9 Procedure regarding amendment of byelaw.

  • Rule 9 (i): Amendment shall be made by a resolution passed in the

  • General body by 2/3rd majority of members present and voting.

  • Resolution should be forwarded to the Registrar within One Month from the date of general body meeting in which amendment was made.

  • Byelaw with all amendments should be kept by the society permanently

  • For convening a General body meeting, minimum 15 clear days’ notice is to be given to all the members Notice of General Body Meeting

  • Rule 9 (ii): If the total membership is not more than 1000, (OLD 500) the notice for amendment can be intimated to the members either in person or through Registered Post or Speed Post or such courier service approved by the High Court of Kerala /State Govt.

  • If the total membership is more than 1000, the notice for amendment can be intimated to the members through publishing it in at least 2 vernacular language newspapers having wide circulation in the area of operation of the society,

  • The notice of Amendment should be affixed in the notice Board of Society’s HQ and Branches, Office of Asst. Registrar and Asst. Director

  • Office of CCU, Panchayath or Municipality or Village Office.

  • In addition to that the Society may inform the date of meeting by SMS

  • E-mails, Advertising in local television channels and Banners.

  • Application for Amendment contains details regarding

  • Rule 9 (iii): The application for amendment of byelaw should be signed duly by “Secretary and two committee members”

  • Date of the general body meeting at which the amendment was made

  • The number of days notice given for the general body meetings

  • The number of days notice required as per byelaw

  • Total number of members required for quorum for the meeting

  • Total number of members present at the meeting

  • Number of members who exercised their vote at the meeting

  • Number of members who voted favourably for the amendment

Rule 9 (iv) proposal shall be accompanied by

  1. A copy of the relevant byelaw in force with proposed amendments to be made together with reasons justifying such amendments

  2. 4 copies of text of byelaw that would stand after amendments signed by the officers authorized behalf of the committee

  3. Treasury chalan receipt for Rs 1000/- and in the case of Women or School or Scheduled Caste/ Scheduled Tribe Cooperative societies chalan receipt for Rs 50/- shall affix
