Constitutional Basis: JSPSC is not a permanent constitutional body. It can be created under Article 315 of the Constitution if two or more states pass a resolution requesting its establishment. The Parliament can then create it by law.
Establishment Procedure: Unlike the Union Public Service Commission (UPSC) or State Public Service Commissions (SPSCs), a JSPSC is not automatically established by the Constitution. It requires a specific legislative act by Parliament following a resolution from the participating states.
Appointment of Members: The Chairman and other members of a JSPSC are appointed by the President of India.
Term of Office: The Chairman and members of a JSPSC hold office for a term of 6 years or until they attain the age of 62 years, whichever is earlier. This is similar to the term for members of UPSC and SPSCs.
Removal of Members: Similar to UPSC and SPSC members, the Chairman and members of a JSPSC can be removed by the President on grounds of misbehavior, after an inquiry by the Supreme Court, or in cases of insolvency, infirmity of body or mind, or engaging in paid employment outside their official duties.
Independence: The JSPSC enjoys a degree of independence to ensure fair and impartial recruitment for common services of two or more states.
Functions: JSPSC advises the participating states on matters relating to recruitment by competitive examination, promotions, and transfers from one service to another, and on all disciplinary matters affecting persons serving under the government of those states in a civil capacity.
