Section 72: Penalty for breach of confidentiality and privacy
Definition:
Section 72 of the IT Act deals with unauthorized access to or disclosure of information without the consent of the person concerned. It is intended to protect individuals' confidential information and privacy from unauthorized actions by those who have lawful access to such information.
Whoever, in pursuance of any of the powers conferred under this Act, has secured access to any electronic record, book, register, correspondence, information, document, or other material without the consent of the person concerned and discloses such information to any other person, shall be punished.
Punishments:
Imprisonment for a term which may extend to two years.
Fine which may extend to one lakh rupees, or both.
