The Chief Election Commissioner and other Election Commissioners of India are appointed by the President of India on the recommendation of a Selection Committee.
This Selection Committee, established by a 2023 law, consists of three members:
The Prime Minister (Chairperson)
The Leader of the Opposition in the Lok Sabha (or the leader of the single largest opposition party)
A Union Cabinet Minister nominated by the Prime Minister
This process replaced the previous system where the President appointed them on the advice of the Council of Ministers, and a 2023 Supreme Court ruling had temporarily created a committee that included the Chief Justice of India. The new law has since altered that composition, giving the government a majority on the committee.
